Terms of Service

1. Introduction
These Terms of Service (“Terms”) govern your access to and use of the TableServe platform (“TableServe”, “the platform”, “we”, “us”). TableServe is operated by Karthickraja Dhakshinamoorthy, based in Durban, KwaZulu-Natal, South Africa. By accessing or using the platform, you agree to be bound by these Terms.
2. Who these terms apply to
These Terms apply to:
- Restaurants that subscribe to TableServe to operate QR-based ordering at their venue
- Staff members of subscribed restaurants who use the kitchen, waiter, or owner portals
- Customers of subscribed restaurants who place orders by scanning a QR code at their table
- Any visitor to tableserve.co.za
3. What TableServe does
TableServe provides software that lets restaurant customers view a menu, place orders, request the bill, and call for waiter assistance from their own mobile device by scanning a QR code at their table. Orders are displayed on a kitchen display and waiter interface operated by the restaurant. TableServe does notprocess payments, prepare food, or take responsibility for the restaurant's service delivery.
4. Restaurant responsibilities
By using TableServe as a subscribed restaurant, you agree to:
- Keep your menu, prices, and availability accurate
- Honour orders placed through the platform during your operating hours
- Handle payment for orders directly with your customers
- Maintain reasonable security of staff login credentials and deactivate accounts when staff leave
- Comply with all applicable laws, including food safety, consumer protection, and tax obligations
- Display required notices to customers (allergens, alcohol licence terms, etc.) as required by law
5. Customer responsibilities
If you are a customer using the platform to place an order at a restaurant, you agree to:
- Order only what you intend to pay for
- Use the platform only for legitimate ordering at the table you are seated at
- Resolve any dispute about food, service, or payment directly with the restaurant
6. Fees and billing
Subscription fees, if any, are agreed separately between TableServe and each restaurant. During pilot and trial periods, the platform may be provided free of charge. Fees, when applicable, will be communicated in writing before they apply.
7. Acceptable use
You agree not to:
- Interfere with the platform's normal operation (including automated scraping, denial of service, or attacks)
- Attempt to access accounts, restaurants, or data that do not belong to you
- Use the platform to place fraudulent orders or to harass staff or customers
- Reverse-engineer, copy, or resell the platform without written permission
- Use the platform in a manner that violates any law
8. Intellectual property
All software, design, branding, and content of the TableServe platform itself remain the property of the operator. Menu content, restaurant branding, and customer order data uploaded by a restaurant remain that restaurant's property. By using the platform, the restaurant grants us a limited licence to display and process that content for the purpose of operating the platform.
9. Service availability
We aim to keep TableServe available and operating correctly, but we do not guarantee uninterrupted, error-free, or completely secure operation. Scheduled maintenance, third-party outages (hosting, database, internet), and unforeseen incidents may cause temporary unavailability. We will make reasonable efforts to minimise such disruptions.
10. “As is” / no warranties
To the maximum extent permitted by applicable law, the platform is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the platform will meet your specific business requirements or that it will operate without interruption or error.
11. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall the operator be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, customers, goodwill, or data, arising out of or in connection with your use of the platform.
Our total aggregate liability for any claim arising under or in connection with these Terms, whether in contract, tort, or otherwise, shall not exceed the total fees paid by you to TableServe in the twelve (12) months immediately preceding the event giving rise to the claim. Where no fees have been paid (for example, during a free pilot), our total aggregate liability shall not exceed ZAR 1,000.
Carve-outs: Nothing in these Terms excludes or limits liability that cannot be excluded or limited by South African law, including liability for death or personal injury caused by gross negligence, fraud, or willful misconduct, or consumer rights under the Consumer Protection Act, 2008.
12. Indemnity
You agree to indemnify and hold harmless the operator from any claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your violation of any law, or your infringement of any third party's rights through your use of the platform.
13. Termination
Either party may terminate a restaurant's use of the platform with reasonable notice. We may suspend or terminate access immediately for material breach of these Terms, non-payment of fees, or conduct that risks harm to the platform or its users. Upon termination, you may request export of your data within 30 days; thereafter, data may be deleted in accordance with our Privacy Policy.
14. Changes to these Terms
We may update these Terms from time to time. Updates will be posted on this page with a revised “last updated” date. Material changes will be communicated to active subscribed restaurants by email. Continued use of the platform after a change constitutes acceptance of the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa, with venue in Durban, KwaZulu-Natal.

16. Severability
If any provision of these Terms is found to be unenforceable, the remainder of these Terms shall remain in full force and effect.
